Hello,
I have a question about ARC. I applied for PR through Delhi after marriage in November. I had an interview in Delhi in June (which I was successful in - terms of genuiness of relationship) - and now I have applied for ARC as a result of being deported from Canada due to overstay.
I was just wondering if anyone can let me know how long does an ARC take to get and if you know of any reasons that it can be denied.

Depends how they look on it,I also got married in November and in April I applied for PR through office in Buffalo mean first I sent my application in Mississauga where they approved the sponsorship and then they sent it in Buffalo like they said the application have to be outside Canada,but unfortunately I had to leave in June the same reason like you due to overstay, so now I'm back home in Europe.
In August I received an e-mail from Buffalo that I can apply for ARC in overseas embassy but they were not sure am going to get....like reason it was that my application has to pass first stage I'm not sure what is that and of course they can answer what is the first stage and that has to decide the officer in embassy where you will apply,also they wrote that the case should remain in buffalo but at some point I will have to present my valid passport in their office by mail or in pearson.That was exactly four months after Buffalo received the application I said I'm in Europe now and my application is in USA.
So I went in embassy and they took my papers and checked them and after they call me in and said that Is not necessary for me to apply and to spent the money (application is CAD$ 400) they not gonna let me go back because I already overstay and I have PR application in buffalo,so I have to wait Buffalo decision to go back I also asked them when I was leaving I been told that I can apply for ARC but in embassy they said like ARC is been offered me just like a n alternative but It doesn't mean that I will get it,but that doesn't mean nothing cause every case is a different so I hope you gonna have more luck then I and there is some cases where they actually allowed some of them to came back,do not lose a hope.
so basically I have application in process for over 6 months and as far as I know they doing the background checking for last 4 months.
If you can tell me how long you have application in process.

I would like to ask you an important question. Your answer will help many members here. "Why did you apply out of Canada instead of in Canada? you were already in Canada at that time." "Have you been aware that you could have applied from within Canada and that your overstaying issue could not cause you any problem according the change of law of Feb 2005"?

Hi,
Well when we sent the application to CPC in Mississauga I think that was like middle of February for sponsorship approval they contact us by phone saying cause I'm citizen other country application should be submitted outside of Canada and that is faster way for process to be completed basically I been advised from Mississauga office, like inland process is takes more time to complete like more then a year or even longer, so they said they will transfer the case to the nearest outside visa office which was a Buffalo.
It was a chance for me to stay in, after my visa expired they said if buffalo can granted me status for landed immigrant I can stay, but my app was in process only month in half and the time to precess app from buffalo usually is from 3 to 8 months, so it was only shortly in process so they could not granted me and I have to leave and wait outside till they complete app.
But no I have not been aware about that law that you mentioned cause i didn't have a lawyer or adviser for immigration and I didn't checked their web site, I would say luck of information, Which turns on It could be better for me.

hi guys i have the same case i applied for pr from canada and then i have to attend my interview in islamabad pakistan and then i got refused and then accepted in appeal and now i applied for ARC from oct 2007 and still waiting for the result of ARC and not sure how long it will take can any one tell me |

ARC is Authorization to Return to Canada.
It has to be apply for ARC in following:
Exlusion order,Deportation,Departure becomes deportation or Volunteery departure.....etc
If you want to return in Canada.

How long does it take depend from embassy to embassy,only I know in Buffalo is from 2 to 6 months and Seatlle is from 1 to 3 months, for others embassy no idea.
to answer you better you have to provide more details.

In my case, after we got approval for sponsorship from CPC Mississauga, they sent the application to Buffalo I got the AOR but also cause I was faild refugee climate and been subject of an unenforced removal order, I had to leave in order for Buffalo to proceed with my case it,I was asked to withdrewed my PRRA Application and voluntary departure from Canada (covered all costs)that was in june/2007. Also in letter they said:
"Once you have submitted the Certificate of Departure (IMM0056) you will then required to apply for an Authorization to Return to Canada.
The fee for this authorization is $360.USD OR $400.CAD and will be requested when required."
In December/2007 I got A letter from Buffalo requesting:
Original police certificates for xxxxx from the following countries xxxxxx
Right of Permanent Residen Fee to be paid by sponsor to CPC Mississauga.
and Authorization to Return to Canada kit to be complited and send back.
so far....still waiting for decision? |

| thanx alot peter i really apriciate ur help in my case i was failed refugee clament in canada and afre that we applied for sponsorship and refused and then accepted in appeal and now my case is being started in proccess from march 2007 in islamabad pakistan and they issued me certificate of departure from canadian embassy in pakistan and now i applied for ARC from oct 2007 and still waiting thanx again and be in touch God bless u |

I think you should be fine,if you won appeal and they have start your application once again you have to have ARC to land in Canada before they issue a PR visa that is normal process that I was explained be immigration officer before I left Canada.
I have PR application in process since April/10/2007 in Buffalo.Did embassy sent you a ARC application kit to complite?Did they ask you to paid Right of Permanent Resident Fee?In application kit they say the time for normal processing time for ARC appl.
As I said it should be possitive decision once you won an appeal.

thanx again peter yes embassy asked me to pay the fee for ARC 400 canadian dollors and there was no specific application form for ARC they say just writed down a siple aplication which have to be explained that why they should issue me authorization to return to canada and i send with the fee further more i already deposted the fee in advance they just sent me the aplication form for pr application and my process is started from march 2007 and they sent me a letter for medical in may and also a letter for interview at the same time and my immigration officer said again and again that this interview is just to confirm ur departure date only and then ARC is being started from oct 2007 |
