My partner and I will be submitting our inland application for sponsorship around mid-August, and her tourist visa will expire on Oct 1, 2008.
(1) Should I apply for a TRP or just a tourist visa extension? What is the difference between the two?
(2) If I apply for a visa extention, then can I just tell immigration the purpose of the extension is to " maintain legal status while the PR application is being processed"? I mean, will immigration see this as a legitimate reason?

IF this is an inland application I would submit a work permit application with your application. This will give her "implied status" while you wait for the first step of the process (stage one approval or approval in principle).
I should mention that the receipt for the fees and all necessary documents must be included with your application for the work permit.
This will prove invaluable because if CIC drags it's feet you don't have to renew a visitor's visa over and over. |

1. There is a big difference between a Temporary residence permit and an extension of your partner's temporary residence status in Canada. A TRP are only granted to those who are inadmissible to Canada, but has compelling reason to be granted temporary status to enter Canada. What your partner wants is to apply for an extension of her temporary residence status in Canada. To do so, she needs to submit form IMM1249. The link to that application is:

2. Yes, that's one way to maintain legal temporary status while having an inland PR application in process. But can I suggest a better way to maintain her status in Canada? Use the same IMM1249 form, but instead of extending her visitor status, check box "C" and apply for an initial work permit. The fee is $150 instead of $75. Include the extension application with your inland PR application that you will be submitting in mid-August (in the same envelope, but bundled separately). This way, your partner will continue to have implied status after Oct. 1, until a decision is made on the open work permit application (which is done when her inland PR application is granted approval in principle). |

I agree with Ginaypp. I did the same. I applied inland for PR and OPW at the same time in Feb 08 1,5 month before my tourist visa expired. So till my OWP will be issued I have implied status. I didnt pay any fees from turist visa extenstion of course.

hey crossover, i asked for an extension of my visitor's visa and the reason i used was that i had a pending sponsorship application and i wanted to stay with my spouse here in canada while waiting for it. they granted the request and gave me a one year extension. note though that my sponsorship application was an outland one. |

I wish I had known I could apply outland and still stay in Canada with mu husband.It would be so much faster. Crossover meaby you should think about it? Inland timeline is soooooo slow.

outland v. inland...oh well i guess that really depends on every person's situation. outland is definitely faster. my PR just got approved this monday (5 months after we submitted it to missisauga for the sponsor's part). the extension of my visitor's visa is valid until june 2009, guess i won't be needing it for that long after all.
another thing though, my spouse and i talked to an immigration consultant before submitting our application (of course we were debating about inland v. outland) and the consultant said that it is almost automatic that CIC will grant an extension of visitor's visa if your application is inland however he did not gave us the same guaranty for an outland application. we took the risk though and still went ahead with an outland application and when my visitor's visa was about to expire i submitted the request for an extension (i submitted it just 5 days before the expiration!).
i guess i got lucky. |

I am also being sponsored by my wife, we both r in canada but applied outland through buffalo as i was intl student here, my study permint is expiring on July31st 08 so i have also applied for Visit permit extention with reasons that waiting for my spousal result and my wife also attached a letter along with $1040 spousal fee receipt copy. But no where we mentioned its OUTLAND or INLAND, do you think they will figure out them selves? or simply will grant extention based on our reasons. As i know inland 100% they grant outland there is a risk. I dint want to state outland to make it simple for them.

the same idea crossed my mind when i was preparing my visitor's visa extension. i thought that maybe it will be better if i don't tell them right away that the sponsorship application is outland because i was also worried about the risk of them refusing my extension. but at the same time i also thought that if my reason for asking an extension is that i have a pending sponsorship application they might want to verify that and so either way they will find out that the sponsorship application is outland. so in the end i decided to be honest and straightforward about everything. i even included in my request for extension a copy of the AOR i received from the embassy processing my sponsorship application overseas as proof that truly i have a pending application.

Like ginaypp & wongn have suggested, I will submit apply for an initial work permit instead of just renewing her visitor's visa.
However, I can't seem to find where the fees are stated. Sorry, I understand wongn has already told me it's $150 but I am a bit nervous right now and would like to make sure that it's $150 and not more.
jmv1217 & palden: I understand that outland applications have a much shorter timeline, but I was worried about the risks involved (e.g. not granting an extension to allow my partner to stay in Canada if I applied outland), so I want to play safe. Thanks for the reminder though! =) Congratulations to jmv1217 for your PR approval. |
