I am just curious and I hope someone will be able to help out with some explanation perhaps...
A denied refugee claimant applied for the Spousal support PR application shortly before submitting the PRRA form....
Recently got a call saying he shld pick a date for interview, misled by the lawyer that its the interview for the PR application unknowing its for PRRA....the question now is.. If PRRA isnt successful, will the applicant be required to leave Canada and whats gonna happen to the Spousal support application??

| Hi, my husband was denied his PRRA, he had to leave Canada, he left on february 28-08, we had sent his application by then...Good luck. |

Hey Missingdave....
Thanks for the response... Now my other question is...
How long was the time frame between the PRRA and when your husband had to leave Canada?? And did he get the denial on the same day or he had to wait for another excruciating days/weeks before the denial.... and did you have to go with him to the PRRA interview??
I know its more than one question.. lol...

My hubby never had an interview so maybe you will get a positive PRRA decision, we sent the PRRA in october of 07, I believe we got the denial letter after 4 weeks or so (I can't really remember the date), we had not file inland, so after PRRA was denied he kept on signing with immigration monthly until he was told he had to leave, he bought his own ticket and left, but like I send we had already submitted an outland application (november 07). When is your interview?, can you give us your timeline....thanks |

Well Refugee denied and letter was sent for PRRA showing(the first letter they send to inform you) and I got married a week before I showed up. That is to say, I wasnt married before PRRA came up....
Application for Spousal Support PR was sent in a day before I went back to submit the PRRA application, I had to show them the DHL receipt blah blah and submitted the application which he said they shld get back to me in 6 months or so.... that was back in Jan/Feb 2007....
PR Application sent to Vegreville, AB and PRRA was sent in Feb 2007.... PR was transfered to local office in Scarborough in August 2007 Havent heard from either since then, until last monday that my stupid lawyer called to wrongfully inform me that I am being called for PR interview until I opened the mail y/day and realized its for PRRA...
But they requested to see my Spouse too! I told my spouse I am giving up already, I need to start packing my bags cos I refuse to be an illegal and this processing is long over-drawn already! I am just done with it.. stick a fork in me, I am so done!! |

| Cheer up, its not the worst that can happen....if it is refuse (and I really hope its not) you leave and start an outland application, I know that is a long process but its better than just giving up!! my husband has been gone for more than a year, we have 2 small kids together, last week Guatemala Embassy asked for his passport, I really hope our case comes to an end soon and I wish you good luck on the interview :) |

If the processing of the spousal application has started before the PRRA was initiated you would fall under the new regulation where you can stay until the PR application has been processed. Now since there is only one day in between the two applications, I don't know if they actually put the PRRA on hold.
The only thing I find surprising is the length of the case, they are usually decided in a few month (in our case 6 month, but it depends on your country of origin and if it's save or if it has become saver) and then you are asked in for an interview in which they tell you if it's denied and then give you 30 days to settle your things in Canada and verify if you can pay for your own return ticket and if you are willing to leave. I also don't know why they would want to see your spouse, that's usual not part of a PRRA interview.
It's hard to say, but it might be that they will decide the PR together with the PRRA application and this is usually done by the same I/O in the same local office. Just in case it is for the PR and your spouse is attending, make sure you know everything about each other (color of sheets & cloth, likes, dislikes, hobbies, each others income, work place, family, etc.)
If you are asked to leave, I recommend paying for your own flight and cooperating as much as possible, since CIC will charge you the costs once you apply for PR in the spousal category again (and this is way more than what it actually cost). You will also have to apply for an ARC (Authority to return to Canada) once you have been removed from Canada.
Good luck and missingdave is right, there is always hope. We both have been at the same point as you are right now and after a long wait we are now getting closer to finally having our loved ones back in Canada and get on with our lives. |
