I am a Canadian citizen who submitted a common-law sponsorship in Canada in July 2007. We got married early this year. My husband is a failed refugee claimant. His PRRA decision was delivered recently and has been ordered to leave Canada before the end of this month. I will be submitting a new application (outbound) to sponsor him. I contacted the CIC call centre to confirm a lawyer's advise that I may proceed to do his medical and US police clearances so that I may include them in my new application which I will be in a position to have a complete package by July 2009 for mail out. I was also advised that as soon as he arrives in Mexico, he must start his application for the Authorization to Re-enter Canada (ARC).
Could I please get thoughts about what I have done so far and everybody's experiences to ensure that I do everything necessary and correct. Since we retained a lawyer for our in Canada application about 2 years ago, I hesitate to pay all over again. Thank you to all who will be responding to this. |

rkbquinn, you have been responding to many postings lately, and most of your responses are incorrect, either you don't understand what has been asked by an OP or you misunderstand the whole question. I know you are trying to help . . . but misguiding some one who is already lost is not a help. We appreciate if you just refrain from responding without giving much thought to initial posting. (nothing against you, hope you understand)
mfeq, there is a thread on this forum where people have been ordered to leave like your husband has and going through an ARC process, please post your question there and they will guide you. Here is that thread: http://www.immigration.ca/discussion2/topic.asp?TOPIC_ID=29495&whichpage=53
Best of luck. |

| Hi mfeq, don't worry you are not alone. The thread mnisar mentioned is all abou ARC's and a few of us have gone through Mexico. This is probably not what you want to hear, but pepare for a long road ahead. The ARC application is now taking 9-12 mos at the embassy in Mexico and they usually only start processing the ARC once they have decided the sponsorship application. As far as know they won't process both applications simultaneously. They will also be scrutinizing your relationship way more because of the deportation etc... so be prepared to demonstrate the bonifides of your marriage both in your application and at an interview (which is likely to occur). On a positive note, a bunch of us on the ARC thread that have jus gone through all this. So read through it and then see if you have other questions. Good Luck! |

| Thank you for both responses. Today is a good day for us !!! CIC Scarborough called us after receiving my fax sent yesterday requesting to withdraw our inland application so that I could commence the outbound from Mexico. The wonderful woman at CIC had asked us to come in today and on the spot approved us for the first stage which resulted in staying the removal order. Now my husband does not have to go back to Mexico and gets to stay to go through the process for his permanent residency. We've been asking for a miracle and today we got it! When my husband gets his permanent residency to me is something I will not worry about for now. |

| Is your inland common-law application still active? and if so was the inital notifcation to apply for PRRA received before or after that application was received by CIC Vegreville? If the common-law application is still active, and the application was received by vegreville prior to being notified of his right to apply for PRRA, then you can hold off the removal order until a decision has been rendered! |

Just saw your last entry.
But important info, even if you don't receive first stage approval as long as the application to sponsor was submitted before receiving notice of application for PRRA, then the PRRA can be stayed until a decision is rendered on the sponsorship! |

| PRRA notice was received prior to the inland sponsorship submission. So we were well aware right off the bat of the possibility of the removal being reinforced. The PRRA decision to remove was presented in person on June 3th. The next day, we received in the post CIC letter requesting that we provide updated documents as they were ready to make a decision. The CIC letter was dated June 3rd as well. We greatly appreciate that CIC had acted on expediting the approval to effect a stay on the removal. Our appointment today was not pre-scheduled. We received the call this morning to attend on even date. |

| thanks EveS!!! We received a letter from CIC dated June 23rd requesting to re-do medical, fingerprints for in Canada police checks, PR $490 fee, updated IMM5002 and photocopy of valid passport and 2 photos. With the exception of re-do medical of my husband`s 8-year old daughter who resides in Mexico (she will not be joining him in Canada anytime soon), I will be sending off the package to the Scarborough office tomorrow. At this point, my husband and I are just happy enough that he is still in Canada so whenever he`ll receive approval for his PR is something we will not fret over --- for now...... |
