I am posting this for a friend

Situation:
-Landed with mother and father in 1988, was 1 year old.
-Family left Canada after less than a month.
-Owned a house in Canada until 2004 (doesn't seem this matter at all though).
-Friend has been studying abroad in US for 8 years, about to graduate college, potentially looking for employment in Canada.


From reading this forum and research of IRPA, this situation looks very bleak as my friend certainly does not meet residency requirements. What I cannot find information on is if there are any sections handling the people who got PR under the old Immigration Act of 1976 like my friend did. Any chance on being able to get back into Canada?

Little to none
The rules used to be you had to stay at least 6 months of the year in Canada
That was changed a few years ago to 2/5 years
I've read many cases of where children of PRs argued that, it wasn't their fault that they left Canada, they had no choice in the matter
However, your friend has been studying for 8 years in the US, when he could have come to Canada
Typically it seems the IRB tends to be okay with it if you return to Canada at the first opportunity as an adult
Your friend is over age 18 & had he come back at the age of 18 - he'd have probably won his case - highly doubtful now though
