Quebec Opens New 2016 Immigrant Investor Program (Audio)
Immigration authorities in the Province of Quebec are now accepting new applications under its highly successful Quebec Immigrant Investor Program for a limited period between May 30th2016 and ending February 28th 2017.
This comes as welcome news for high net worth individuals looking for an attractive passive investment program offering Canadian permanent residence. The Quebec program (QIIP) is the only large scale passive investment program of its kind in Canada and the second largest in North America after the US EB-5.
Under the new subscription period, Quebec will accept a maximum of 1900 applications including a maximum of 1330 from China, Hong Kong and Macao and the balance of 570 applications to be filled from elsewhere.
The QIIP 2016 program application quotas and the limited period of reception do not apply to applicants to the investor category who can demonstrate an intermediate to advanced level of French language proficiency through an approved standardized language test.
QIIP 2016 Program Highlights
To be eligible, applicants must demonstrate the following:
- A legitimately acquired personal net worth of at least 1.6 million Canadian Dollars;
- At least two years of senior managerial experience within the past five years in a private enterprise, eligible partnership, government body or NGO;
- Commit to making an interest free investment of CAD $800,000.00 in a prescribed (government guaranteed) investment for a period of five years;
- An intention to settle in the province of Quebec;
- Application processing fee of C$15,000.
Applications must be fully documented at the time of submission. Quebec policy now provides for the refusal of applications that are incomplete or otherwise inconsistent with the requirements, without requests for outstanding documentation or incomplete information.
Applications are submitted through government approved financial intermediaries who act as facilitators and are each given pre-determined allocations within the overall maximum of 1900 applications. Applicants who wish to secure a quota position with a financial intermediary – facilitator may do so with a negotiated deposit.
For many business immigrants, one of the most significant benefits of moving to Canada, largely overlooked, can be the ability to distribute the accumulated profits of their foreign business in a tax-efficient, often tax free manner. The Definition of a ‘Refugee’ Narrows Under the Liberals
The story is brought to light of a Syrian national who left his war torn home in Syria, Homs, before the civil war began, moving to Dubai for work in 2010. Six months before moving to Istanbul last year, his parents received a letter ordering their son to report for military service in the Syrian army. His family immediately advised him never to come home as this would mean he would be taken directly from the airport to military training. Ismail represents a growing subgenre of refugees, draft dodgers, and similar people fleeing regime-held areas in general.
After losing his job and having his visa revoked in the United Arab Emirates, the individual was forced to become a refugee in Turkey, one of millions waiting for an opportunity to start a new life in Europe.
In Canada, the new Liberal government barred single men from its plan to resettle 25,000 Syrians here disqualifying an estimated 70,000 draft dodgers who are predominantly single males. According to an August 2014 report published by the Immigration and Refugee Board of Canada, military-aged men are the “most vulnerable” of any Syrians returning home.
For almost a year now, European Union leaders have struggled to stem the flow of refugees arriving in Greece from Turkey. Economic migrants were the first to face deportation from Europe last year and specific nationalities were targeted: Albanians, Armenians, Pakistanis, sub-Saharan Africans and this year Afghans have been added to the list.
On March 8, a day after Turkey and the European Union agreed in principle to a deal to contain the flow of refugees, European Commission President Jean Claude Juncker announced “irregular migrants” or those not fleeing actual fighting, would retain refugee status but still be shipped back to Turkey and “put on the bottom of the list” for resettlement.
The plan has come under fire from Amnesty International and other human rights groups who have accused Europe of ignoring the rights of refugees, while also breaking international law by designating Turkey a “safe third country” for refugees.
According to the head of Amnesty International’s European Institutions Office, Turkey has forcibly returned refugees to Syria, and many refugees in the country live in desperate conditions without adequate housing.
In mid-February of this year, President Assad announced a general amnesty to deserters and draft dodgers. Men of military age were given until mid-April to turn themselves into Syrian authorities. But many are skeptical as stories abound of what happens to a deserter if one return back to Syria. Many stories are told that deserters are sent straight to the frontlines.
Draft dodgers are essentially being punished by Europe for being draft dodgers and will be punished for the same crime by the Syrian regime if they return. People who refuse to serve in the Syrian army because they don’t want to be involved in violations of international law clearly should be granted refugee status.
With a deal between Turkey and the EU soon to be implemented, many young men along with potentially hundreds of thousands of others deemed unworthy of protection will face intense rejection from the very governments they hoped would protect them.

Canada Must Embrace Foreign Tech Companies
The tech industry is a global one. Canada’s best tech entrepreneurs already understand the value of building international relationships as a number of such companies choose to base their companies in Canada. Prime Minister Trudeau was recently present for Google’s launch of its new Kitchener-Waterloo engineering office. Earlier that same day, Trudeau visited BlackBerry and the University of Waterloo, bringing to light the positive impact of Google’s presence for the local tech community.
In addition to creating world-class jobs for Canadians, Google has worked with Communitech, Waterloo’s non-profit innovation centre, to set up Canada’s first Google for Entrepreneurs hub. It provides local startups with mentorship, resources and connections into Silicon Valley.
Over the past decade, Google’s acquisitions of local startups financially enabled its company founders to invest some of the proceeds back into other local startups in the form of angel investments, and to lead promising new ventures such as Axonify, a Waterloo software company.
Google’s growing Waterloo presence has also served as a beacon to other Silicon Valley companies such as Square, NetSuite and Everalbum. This is a perfect example of how international companies breathe fresh life into a Canadian ecosystem in the wake of the collapses of Nortel and BlackBerry. The Canadian economy has picked itself up from those two losses were, emerging stronger with several homegrown companies growing significantly; risk-capital investment trending upward; continued excellence in research in such fields as quantum computing; and a coast-to-coast explosion in startup activity supported by incubators and accelerators.
While it is worth discussing the role federal policy can play in building the best innovation strategy for Canada, it is equally important not to allow protectionism and insecurity from holding opportunities back. By increasing the total number of technology jobs in Canada, future generations will benefit immensely from a successful tech sector. In fact by many accounts, by 2019 there will be as many as 182,000 high-paying technology jobs up for grabs in Canada. Companies seeking to employ temporary foreign workers in this sector must be able to hire, train, and retain its workers.
In the bigger picture, the rise and fall of tech companies is part of the renewal cycle that Canada aims to embrace and foster. Our strength can only increase as more Canadians gain exposure to the kind of success that the Googles, Apples and Facebooks of the world represent.

Canadian Tax Opportunities for Foreign Business Owners
Canada offers a number of permanent immigration options for business investors. Many business immigrants to Canada own and operate a business in their country of origin. For these immigrants, one of the most significant benefits of moving to Canada, largely overlooked by most consultants, can be the ability to distribute the accumulated profits of their foreign business in a tax-efficient, often tax free manner. This can represent a major financial tax benefit for individuals living in countries that impose high taxes on corporate distributions.
For example, consider a non-Canadian individual that owns an incorporated business in a country that imposes a tax of 30% on dividends. Assume that this business has retained earnings of $10 Million. A distribution of all of the retained earnings to the individual would therefore give rise to $3.0 Million in tax ($10 Million x 30%).
Now consider the tax treatment of that same distribution if the individual immigrates to Canada and implements some strategic tax planning. In one common plan, the immigrant arriving in Canada transfers the shares of his foreign business to a Canadian holding company in exchange for shares of the Canadian company. Under existing, favorable tax rules that apply to immigrants, Canada will grant the individual a full tax basis in his foreign shares, equal to the fair market value of the business at the time of immigration. Canada will also grant the individual the same full tax basis in the shares of the Canadian holding company to which the business is transferred.
In this scenario, dividends will flow from the foreign company, to the Canadian holding company, and finally to the immigrating individual. These dividends will typically be subject to foreign dividend withholding tax in their country of origin at a treaty-reduced rate of 5%. However, the dividends will not be subject to any additional taxation when received by the Canadian holding company. In turn, the Canadian holding company can distribute the dividend proceeds to the immigrating individual in a tax-free manner as a return of capital (i.e. a return of tax basis). In total, the tax paid on the $10 Million distribution to the immigrant will be $0.5 Million, rather than the $3.0 Million that would have been paid by the immigrant in his country of origin, representing a tax free benefit of $2.5 Million.
The two scenarios are illustrated below:
This is only one example of effective planning strategy, and Canada’s tax regime offers many other tax-saving opportunities for new business immigrants. The most appropriate strategy will be tailored taking into account applicable Canadian tax rules, and the tax rules in the immigrant’s country of origin that govern emigration and foreign corporate ownership. In many cases, with proper advance planning, there will be a clear overall tax benefit in immigrating to Canada.

New Program to Attract Newcomers to Canada’s Francophone Communities
A new International Mobility Program will launch in June 2016 and aims to attract skilled francophone workers to Canada while encouraging them to settle in francophone minority communities outside of Quebec.
From June 1, 2016, the Mobilité Francophone stream will exempt employers from the Labour Market Impact Assessment process when they hire francophone workers in managerial, professional and technical/skilled trades’ occupations.
The Immigration, Refugees and Citizenship Canada aims to have francophone newcomers make up at least 4% of all economic immigrants settling outside of Quebec by 2018.
Immigration Minister John McCallum added, “We’re going to encourage skilled francophone workers to apply for permanent residence if they would like to stay.”
“Canada’s diversity is enriched by our francophone minority communities all across the country,”said Canadian Heritage Minister Melanie Joly. “We want to see these communities flourish across Canada and immigration is strategic to preserving their vitality and prosperity.”

Ottawa to Improve Express Entry System and Temporary Workers’ Program (Audio)
The federal government recently announced changes to Canada’s immigration system that will make it easier for foreign students to stay and work in Canada after they graduate. It also plans to improve the Temporary Foreign Workers Program (TFWP).
Current rules
The previous government changed the rules of the two main immigration channels: the temporary foreign worker (TFW) program and the permanent immigrant system that awards points to potential immigrants. The changes had some positive effects and but also changed the type of people who can immigrate to Canada.
The changes limited the types of workers companies can bring in, made the screening process more rigorous and set an employer-specific limit on TFWs.
In the past, permanent immigrants were not substitutes for existing Canadians because the criteria in the points system did not reflect what businesses needed. The new seasonal exemption allows more TFWs into Atlantic Canada. It also means TFW’s compete with residents for seasonal jobs.
The express entry system was one of the major changes made by the previous government. Candidates with a Canadian job offer are able to migrate to Canada much faster than before.
While the changes to both the TFW and permanent immigrant programs were designed to better meet current labour-market needs while safeguarding job opportunities for Canadian workers, they have some unintended consequences that need fixing.
Planned changes
Immigration Minister John McCallum recently said the government plans to adjust the express-entry system to allow recent international graduates of Canadian universities to transition into the permanent express entry immigration system.
As well, beyond Atlantic Canada, TFWs will no longer be seen as competing directly for jobs with Canadian workers, including workers who are willing to move to where the jobs are.
The government should continue to promote economic opportunities for Canadian residents seeking employment in their own province or moving to other provinces in search of better opportunities. More consideration should be given to attract immigrants with skills the Canadian economy may need currently and as well as in the future. This is known as the human capital approach to immigration, a policy international immigration stakeholders continue to endorse.

Canada’s Future Appears Brighter under Trudeau’s Liberals
In 2015, Canadian voters elected Prime Minister Justin Trudeau, a leader with a vision for the country. Trudeau promoted inclusion and tolerance, focusing on the need to bring people together to solve problems. He promised to cut middle-class taxes while tackling climate change.
Despite Canada’s economy being weighed down by a low Canadian dollar and oil prices, and the demise of the Keystone XL pipeline, the bigger picture still looks positive for America’s second-largest trading partner.
Trudeau’s commitment to fighting climate change coincides with his recognition that the Canadian economy has been far too dependent on oil. Trudeau has already won the approval of the markets and local governments.
In both Canada and the United States, cities are often on the leading edge of change. Ontario, the most populous province in the country has initiated a 10-year, $130-billion infrastructure program to improve its roads, transit and hospitals. The bonds sold to pay for those investments have been outperforming the national average, including in oil-rich Alberta. Investors have decided that governments with strong infrastructure projects are a better bet than those that are dependent on fossil fuels.
With Canada becoming one of the world’s largest manufacturers of solar panels, Prime Minister Trudeau seems committed to increasing investment in low-carbon infrastructure and clean-energy technology. Investors and local leaders agree.
Cities such as Montreal and Vancouver have set aggressive targets for reducing greenhouse-gas emissions. The public is being held accountable by making targets publicly available through a standardized reporting platform, the Compact of Mayors. The platform is available in over 400 cities globally.
The investments in a low-carbon economy will help address another challenge facing the Canadian economy: individual and corporate cash reserves, which now stand at more than $500-billion. As more infra structure is built, more private-sector investment will follow, drawing more funds back into the market, leading to an increase in economic growth and tax revenue. Low interest rates means there has never been a better period for governments to borrow money payable long into the future to build new transit, schools and hospitals. Locally led actions that are aligned with market forces can drive a new era of growth for Canada.
Justin Trudeau has shown that strong economic leadership begins with uniting people around a realistic vision that can be fulfilled if government works in concert with markets.
Only time will tell how successful this approach will be for Canada’s new liberal government.

New Research Shows Degrees That Lead to High-Paying Jobs and Lower Unemployment
When high school students are faced with one of the most important decisions of their lives—whether to attend college or university, and which course of study to pursue, they often base their decisions on « anecdotal information,” The reason for this is a lack of reliable information on how students perform in the labour market once they graduate.
This lack of information makes it hard to make an informed decision when picking a diploma or degree that will lead to a great job at graduation. Students are not the only ones who benefit. The information can also help policy-makers and institutions tailor their programs accordingly.
The Education Policy Research Initiative (EPRI) at the U of O, and is leading a new initiative aimed at quantifying student success with the power of actual data.
Starting with students at his Ottawa institution and broadening out to 14 colleges and universities across the country, the institute is tracking each student through school, and years later, using tax data (in partnership with Statistics Canada) to chart how each performs in the job market in the long term. The data does not name students and strict security protocols are in place to guard privacy.
Under the current program, the EPRI is tracking close to half a million young people across Canada who graduated from 14 colleges between 2005 and 2013, the last year of tax data available. The results from this latest project will be published shortly.
In previous studies, the EPRI’s grad earnings study of 2014, followed University of Ottawa students and found that social sciences grads start out with average earnings of around $40,000, reaching $80,000 13 years later.
Currently, Canada only has one way of tracking its students after they graduate. Compiled by Statistics Canada, the National Graduates Survey relies on self-reported data, and was last published in 2013. Akela Peoples of the non-profit Learning Partnership, which supports publicly funded education in Canada, agrees that good data on student outcomes is hard to come by, with current data being outdated.
British Columbia has its own system of tracking graduates: the Baccalaureate Graduates Survey, carried out as a partnership between the universities and the provinces, which surveys students two years after they finish. The EPRI project at the University of Ottawa linked 99 per cent of all students up to their tax data, capturing a complete picture.
At Mohawk College, in addition to tracking grads, the EPRI is using predictive models to identify students who may need extra help. Using all sorts of information like age, gender, entering grades, socioeconomic background and more, and the college sends emails to alert students to various services on campus—maybe a student success adviser, or a counsellor at Aboriginal Student Services. « It’s an opportunity to communicate.” says Wayne Poirier, vice-president of student services. Mohawk sees it as a way to increase graduation rates, and support students throughout their studies.
However, tracking efforts like this one do come with their own set of challenges—navigating privacy rights in each province, for example.
Universities are being ranked more than ever, and many of them proudly trumpet positive results in international rankings like the Times Higher Education World University Rankings. Forbes magazine publishes rankings of business schools based on a student’s “return on investment,” or how many years it takes a graduate of an M.B.A. program to earn back the money they spent on the degree. Last year York University’s Schulich School of Business was the only Canadian school to be mentioned in the top 10 list of best two-year M.B.A. programs offered outside the U.S.
It’s also important to see whether students themselves would use this data to plot career trajectories.
According to the Learning Partnership, Canada’s youth unemployment is nearly 14 per cent, twice the general population. Young people are keen to gather more information on where the jobs are, and how they can get to those positions.
A mobile and web app, Real Talk, launched by the Learning Partnership and aimed at high school students, saw an unprecedented number of downloads immediately after launch. The app gave students advice from peers about finding work, and eventually a career and its popularity goes to show that, for many young Canadians, issues of employability are a top priority.
Tracking methods such as EPRI do challenge universities to deliver graduates who are job-ready. The goal for future versions of the program is to track more paths followed by those who leave college and university and perhaps track graduates from every postsecondary institution across the country with the help of Statistics Canada. This it is hoped will reduce rates of unemployment of this age cohort.

2016 Tirage Entrée Express #7 : 1,014 Invitations, plus bas pointage SCG à 470

Il s’agit du vingt-et-unième tirage successif dans le cadre du système Entrée Express où le score SCG le plus bas était sous la barre des 500.
Entrée Express est un système d’immigration mis en place par les autorités canadiennes de l’immigration («CIC») le 1 janvier 2015, celui-ci gère les demandes des travailleurs qualifiés au titre des programmes économiques fédéraux. Cela comprend le Programme fédéral des travailleurs qualifiés, le Programme des métiers spécialisés, la catégorie de l’expérience canadienne et le Programme des candidats des provinces.
Les parties intéressées prévoient de voir les futurs pointages SCG bien en dessous de 500 cette année pour permettre aux autorités canadiennes de remplir leurs niveaux d’immigration annuels cibles en 2016.

Au milieu des années 2000, au cours d’une période de chômage élevé, le nombre de travailleurs étrangers temporaires qui venaient au Canada a commencé à augmenter. À la fin de 2014, plus de 353,000 personnes au Canada ont été admises dans le cadre des programmes de travailleurs étrangers temporaires et de mobilité internationale. Au cours des dernières années, la population des travailleurs temporaires était supérieure au nombre annuel d’immigrants.
En 2014, le gouvernement Harper a fermé le programme en raison d’une vague d’indignation publique après que certaines compagnies aient refusé d’embaucher des Canadiens pour des emplois dans le domaine des services. Elles faisaient appel à des travailleurs non-Canadiens afin de « temporairement » combler ce qui aurait été normalement des postes permanents.
Le gouvernement libéral a récemment annulé certains des correctifs amenés par les conservateurs mais seulement temporairement. Les industries saisonnières sont maintenant libres d’embaucher des travailleurs étrangers temporaires, même dans les domaines présentant un niveau de chômage élevé.
Le gouvernement Trudeau prévoit passer les prochains mois à étudier la question et rédiger des nouvelles règles améliorées pour le Programme des travailleurs étrangers temporaires (PTET). Afin de comprendre ce à quoi les règles canadiennes sur les travailleurs étrangers temporaires pourraient ressembler, il est important d’adhérer à certains principes qui ont fait des politiques d’immigration une force positive pour l’économie et la société.
Il est également important de reconnaître qu’il y aura toujours certaines entreprises qui auront réellement besoin d’aide à court terme de l’étranger, certaines sont présentes dans des domaines hautement qualifiés et d’autres dans des domaines plus saisonniers impliquant du travail à court terme récurrent. Autant que possible, les travailleurs étrangers temporaires devraient être encouragés à devenir des Canadiens. En outre, les employeurs ne devraient pas être en mesure de maintenir les niveaux de salaire bas en apportant des travailleurs qui jouissent de moins de droits que les Canadiens.
En 2014, le Canada a accepté 260,000 nouveaux résidents permanents de toutes catégories, notre taux d’immigration par habitant est passé à un peu plus de 0,7 pourcent de la population canadienne. Ceci concorde avec les niveaux des années précédentes.
Le gouvernement Trudeau envisage d’accepter entre 280,000 et 305,000 nouveaux arrivants en 2016, cela représenterait près de 0,85 pourcent de la population actuelle. Il serait également envisagé d’augmenter la proportion de réfugiés.
En comparaison, en 2013 aux États-Unis un peu plus de 990,000 nouveaux arrivants sont devenus des « résidents permanents légaux ». Avec une population qui est neuf fois celle du Canada, cela situe le taux américain d’immigration légale à 0,31 pourcent – moins de la moitié du taux canadien.
Ces chiffres ne concernent que l’immigration légale qui, aux États-Unis, ne sont pas totalement représentatifs de la situation. Selon le Centre de Recherche Pew, il y avait aussi 11,3 millions d’immigrants illégaux aux États-Unis en 2014. Les immigrants non autorisés sont soupçonnés de hausser de 5,1 pourcent la population active des États-Unis.
Les chiffres canadiens des travailleurs sans papiers sont soupçonnés d’être beaucoup plus faibles et, contrairement aux États-Unis, ce n’est pas une question politique –c’est probablement parce que les chiffres sont en fait peu élevés, et que le chemin de l’immigration légale et de la citoyenneté pour les travailleurs qualifiés, beaucoup plus ouvert.
Il est clair que si le Canada et les États-Unis sont des pays à forte immigration – le modèle canadien a donné lieu à un taux plus élevé d’immigration tout en comprenant une rupture sociale beaucoup moindre. L’accueil d’un grand nombre de nouveaux arrivants dans la famille canadienne se fait d’une manière légale et ordonnée, alors que les États-Unis acceptent seulement un nombre relativement faible d’immigrants légaux, tout en hébergeant simultanément à long terme un grand nombre de participants illégaux.
