The sponsor will typically need to submit the Application to Sponsor and the Undertaking i.e. IMM 1344AE with all the required supporting documents and the proof of fee payment. At this stage, the Case Processing Centre in Mississauga (CPC-M) will need to review the sponsorship forms. It will also need to ensure that the documentation received includes the following documents, which must also be complete:
- Completed and signed sponsorship forms (including the undertaking and the agreement)
- The persons listed on the sponsorship application will need to be members of the family class
- Proofs of payment of correct fees at a bank and,
- All required supporting documents
In some cases, officers might find that the application does not include the minimum requirements specified in R10 (1) and R10 (2). In such cases, the Case Processing Centre in Mississauga (CPC-M) will need to return the application and all documents to the sponsor. It will need to return the Handling Public Moneys (HPM) receipt to the sponsor as well. In addition, it will need to request for the missing information and documents. For more details on this, officers will need to go through the provisions specified in R12.
In case the application is complete, the Case Processing Centre in Mississauga (CPC-M) will need to:
- Assess the sponsor’s and co-signer’s eligibility – for more details on this, officers would need to go through the section titled ‘The Guidelines for Assessing a Sponsor’s Eligibility’ that appears subsequently in this document i.e. section 13 of IP 2
- This will typically include determining the sponsor’s eligibility to sponsor and the co-signer’s eligibility to have the authorities consider their income
- Complete the eligibility check – for more details refer to Appendix A
- Write ‘Met or Not Met’ on the sponsorship application i.e. IMM 1344AE and,
- Enter the basic data information into the Customs Processing Centre System (CPCS)
In case the sponsor meets the prescribed sponsorship requirements for other members of the family class, officers would need to go through the section titled ‘The Procedures in Case the Sponsor Meets the Sponsorship Requirements for Other Members of the Family Class’ that appears subsequently in this document i.e. section 10.1 of IP 2.
In case the sponsor does not meet the prescribed sponsorship requirements for other members of the family class, officers would need to go through the section titled ‘The Procedures in Case the Sponsor Meets the Sponsorship Requirements for Other Members of the Family Class’ that appears subsequently in this document i.e. section 10.2 of IP 2.
The Procedures in Case the Sponsor Meets the Sponsorship Requirements for Other Members of the Family Class
In case the sponsor meets the prescribed sponsorship requirements for other members of the family class, the Case Processing Centre in Mississauga (CPC-M) will need to:
- Enter the recommendation into the system, which will trigger an automatic request to Docupost for sending the permanent residence application to the sponsor for onward transmission to the sponsored people
- Download the sponsorship information and recommendation to Computer Assisted Immigration Processing System (CAIPS) – this will typically include any additional information in the ‘Notes’ box such as:
- Provide the relevant information (including the office of visa issuance and the file number), in case the sponsor received a visa abroad to come to Canada as a refugee or an adopted foreign national and,
- Provide information on the date on which the sponsor met the conditions or from when the sponsor will need to meet the prescribed conditions, in case the authorities granted permanent residence to the sponsor subject to conditions
The Procedures in Case the Sponsor Does Not Meet the Sponsorship Requirements for Other Members of the Family Class
In case the sponsor does not meet the prescribed sponsorship requirements for other members of the family class, the Case Processing Centre in Mississauga (CPC-M) will need to:
- Reimburse the processing fee for the permanent residence application, should the sponsor opt to discontinue the application
- Officers would need to go through the section titled ‘The Procedures for Handling a Discontinued or Withdrawn Undertaking’ that appears subsequently in this document i.e. section 12 of IP 2
- In addition, officers would need to refer to the provisions specified in the section titled ‘The Guidelines Concerning Discontinued Undertakings and the Refund of the Permanent Residence Application Fees’ i.e. section 5.39 of IP 2
- Forward the permanent residence application to the visa office, in case the sponsor chooses to continue with the application
- In addition, the Case Processing Centre in Mississauga (CPC-M) will need to indicate why the sponsor does not meet the prescribed sponsorship requirements in Computer Assisted Immigration Processing System (CAIPS) or,
- Suspend the processing of the sponsorship application until the officers render a decision in case the sponsor and / or the co-signer is the subject of any of the suspensions listed in the section titled ‘The Guidelines for the Suspension of Processing’ i.e. section 5.36 of IP 2
