Canada’s new immigration program favours Immigration.ca and Global Recruiters Network

If recent announcements are any indication, 2008 promises to be an important year in the Canadian immigration industry. That is because the Canadian government recently unveiled its proposed amendments to the Immigration and Refugee Protection Act, the most significant in the past 7 years.

The proposed changes finally attempt to solve the mounting problem of Canada’s large backlog of pending applications for permanent residence by officially launching the Canadian program into an employer driven model. Under the proposed measures, Citizenship and Immigration Canada would have greater flexibility in processing new applications, especially from skilled workers. The legislation is also intended to provide greater flexibility in addressing a range of labour market needs by creating a fast track occupation list. Additional but highly controversial measures will allow for the department to process applications on a targeted “needs” basis, rather than under a first-in, first-out basis which the former system followed.

New rules will permit the Immigration Minister to issue instructions providing for the retention or disposition of an application under a variety of yet-to-be announced mechanisms. The immigration authorities will no longer be compelled to actually process an otherwise qualified application (submitted after February 27, 2008) that does not fit the profile of candidates being sought by the government. So, new applicants who may otherwise qualify for consideration under the applicable federal or provincial rules will no longer be guaranteed that their applications will be processed to visa issuance. It is generally acknowledged however that applicants with approved job-offers will likely be afforded priority.

And with the introduction of the new Canadian Experience Class, expected to take hold later this summer, Canadian authorities will have the tools to give preference to applicants who are currently working in Canada.

Should the new rules take effect in the weeks ahead, Canada will be elevated into the category of the world’s largest employment recruiter and the immigration authorities will have access to one of the world’s largest pool of qualified applicants. “Canada will be able to quickly accept the best and the brightest applicants’ in record time and it is obvious that we will be in an ideal position”, confirms Singer.
