The Mandatory Submission of Language Proficiency Results
As mentioned before, foreign nationals would need to meet the following criteria. They would need to:
- Meet the requirements of being a member of at least one of the following classes:
- The federal skilled worker class referred to in subsection 75 (1) of the Immigration and Refugee Protection Regulations (IRPR)
- The Canadian experience class referred to in subsection 87.1 (1) of the Immigration and Refugee Protection Regulations (IRPR) and,
- The federal skilled trades class referred to in subsection 87.2 (1) of the Immigration and Refugee Protection Regulations (IRPR)
- Meet the requirements specified in:
- Subparagraph 82 (2) (c) (ii) of the Immigration and Refugee Protection Regulations (IRPR) if they are foreign nationals referred to in paragraph 82 (2) (b) or,
- Clause 87.2 (3) (d) (iv) (B) of the Immigration and Refugee Protection Regulations (IRPR) if they are the foreign nationals referred to in subparagraph 87.2 (3) (d) (iii) AND,
- Register with the Job Bank of the Department of Employment and Social Development not later than 30 days after the day on which they submit their expression of interest if:
- They do not have a qualifying offer of arranged employment or,
- Their name does not appear in a nomination certificate issued by the government of a province referred to in paragraph 2 (d) under its provincial nominee program express entry stream at the conclusion of that period
To meet these requirements, foreign nationals might need to provide the results of an assessment of their proficiency in English or French. Typically, organisations or institutions designated under subsection 74 (3) of the Immigration and Refugee Protection Regulations (IRPR) will conduct these language assessments.
On completing these assessments, the foreign nationals would need to provide these language assessment results at the time of submitting an expression of interest. It is worth noting that these language assessment results would remain valid for a period of two years from the day on which the relevant authorities issue these results.
Similarly, in order to meet the eligibility requirements mentioned above, the foreign nationals would need to provide the results of an assessment of the equivalency of their educational credentials to Canadian educational credentials. Typically, organisations or institutions designated under subsection 75 (4) of the Immigration and Refugee Protection Regulations (IRPR) will conduct these assessments.
On completing these assessments, the foreign nationals would need to provide these assessment results at the time of submitting an expression of interest. It is worth noting that these language assessment results would remain valid for a period of five years from the day on which the relevant authorities issue these results.
