The Canada Border Services Agency has the duty of taking enforcement action, in case it comes across incidents of non-compliance. The duties of its officers include:
- Border Services Officers
- They would need to be satisfied that the foreign national meets all the legislative requirements
- Only after they are satisfied, would they allow the sponsored person, who is subject to the condition, entry into Canada as a permanent resident
- They would ensure that the sponsored person signs the Confirmation of Permanent Residence, confirming that the sponsored person understands that they are subject to the condition prescribed by the authorities and,
- They would also verify whether sponsored family members are subject to the condition before allowing them to enter Canada as permanent residents
- Inland Enforcement Officers
- They would review the referral
- They would also evaluate whether the case merits further investigation
- They would need to inform the CIC of the results of all investigations, where the individuals are subject to the condition, so that the CIC can:
- Maintain proper tracking in the GCMS and,
- Render a determination of the overall compliance of the condition
- Criminal Investigators
- The Inland Enforcement Officers would consult with the Criminal Investigations Division (CID) for a possible referral if, during the course of the investigation, the Inland Enforcement Officers, while reviewing the file:
- Unearth evidence of a suspected violation of the Immigration and Refugee Protection Act (IRPA) that warrants a criminal investigation for:
- Organised fraud or,
- Misrepresentation
- Hearings Officers
- They would action cases that are brought before the:
- Immigration Division (ID) or,
- Immigration Appeal Division (IAD)
- Both, the ID and the IAD are part of the Immigration and Refugee Board (IRB)
