Acceptance of Terms and Conditions : ROE Web

Last Updated on December 10, 2016

The Acceptance of Terms and Conditions

This Agreement describes the terms and conditions pursuant to which the Commission would need to make the Record of Employment (ROE) Web available to the account holder.

When the user clicks on the tab titled ‘I Agree’ given at the end of this agreement, the user:

              • Agrees, for and on behalf of the account holder, to remain bound by the terms and conditions of this agreement

              • Warrants that the user has the appropriate power and capacity for executing this agreement on behalf of the account holder

              • Acknowledges and agrees, for an on behalf of the account holder, that any previous Record of Employment (ROE) Web agreement that the account holder might have had with the Commission terminates immediately upon the acceptance of this agreement

              The Amendment

The Commission retains the right to modify the terms and conditions specified in this Agreement at any time without providing any prior notice. However, such amendments would only come into effect after the expiry of a 30-day notice period. Such a notice period will typically commence on the day the authorities post the notice of the change in the Record of Employment (ROE) Web and on the Service Canada website.

The access to or use of the Record of Employment (ROE) Web Account after the expiry of the 30-day period will signify the user’s acceptance of the modified agreement. As such, the Commission remains entitled to rely on such access to and use of the Record of Employment (ROE) Web Account as indicating agreement with the change.

The account holder bears the responsibility for consulting the Record of Employment (ROE) Web on a regular basis. This would help the account holder ascertain whether the authorities have posted any modifications.

The Availability of the Record of Employment (ROE) Web

It is worth highlighting that the Record of Employment (ROE) Web will continue to be available seven days a week, for 24 hours a day, except:

              • During regularly scheduled maintenance or repair or,

              • Because of events that are beyond the control of the Commission or events that the Commission could not have reasonably prevented by means of controls, compromise, disaster recovery procedures or business continuity procedures

Similarly, the Commission makes no representations or warranties. In addition, it disclaims all liability in regards to the availability of:

              • The Record of Employment (ROE) Web because of events beyond its control or events that the Commission could not have reasonably prevented by means of controls, compromise, disaster recovery procedures or business continuity procedures or,

              • Any related technology or intermediary internet services or systems used for supporting or accessing the Record of Employment (ROE) Web

No Charge for Using the Record of Employment (ROE) Web

The authorities do not impose any charges on the use of the Record of Employment (ROE) Web.

The Responsibilities of the Account Holder

The authorities consider the account holder as being fully responsible for:

              • Any use of the Record of Employment (ROE) Web that is in breach of the terms of the Agreement, including the use by any users to whom the account holder grants access to the Record of Employment (ROE) Web Account

              • Ensuring that all the information provided to the Commission via the Record of Employment (ROE) Web Account is true, accurate, current, complete and in perfect compliance with the Employment Insurance Act and Regulations and,

              • Implementing processes or mechanisms that support the accurate validation of the identity of each of the users prior to the completion of the Record of Employment (ROE) Web Enrollment – it is worth highlighting that the account holder would need to provide such processes or mechanisms to the Commission upon request

The authorities require the account holders to certify that the Primary Officer (PO) and the representatives have received the appropriate access levels. In addition, they require the account holders to certify that the Primary Officer (PO) and the representatives have the relevant authorisations for using the Record of Employment (ROE) Web Account. Lastly, the authorities require the account holders to certify that the Primary Officer (PO) and the representatives have the ability to identify and authenticate additional users for acting on behalf of the account holder for the purpose of the Record of Employment (ROE) Web.

The account holder would also need to certify and warrant that:
              • All identity information provided by the users for the purpose of the Record of Employment (ROE) Web Enrollment is both accurate and complete

              • It has no information or knowledge that the identity information of these users (as provided to the Commission during the enrollment process) is inaccurate, incomplete, has changed or has been altered, when seeking enrollment to the Record of Employment (ROE) Web for its users and,

              • The account holder has authorised users for enrollment and using the Record of Employment (ROE) Web in accordance with the access level assigned to them

The authorities require the account holder to notify the Commission if it knows or suspects that:

              • Any user’s username or password has been or may have been disclosed to anyone

              • Any user’s username, password or account has been or may have been accessed or used without authorisation

              • Any provision of this Agreement has been or may have been contravened whether by act or omission and,

              • Any breach of security that affects or could affect the security or the integrity of the Record of Employment (ROE) Web has taken place

Similarly, in accordance with the process that the Commission has established (which account holders could go through on the website of Service Canada), the account holder would need to:

              • Notify the Commission of any change of Primary Officer (PO) and,

              • Identify and authenticate the incoming Primary Officer (PO)
