Appendix B – The Immigration Medical Examination (IME) Obligations

The Obligation to Answer Truthfully

The authorities require that any person who makes an application would need to answer truthfully all the questions put to the individual for the purpose of the examination

In addition, the individual would need to produce a visa and all relevant evidence and documents that the officers reasonably require

The Obligation to Appear for the Examination

The authorities require people who make applications to appear for the examinations on the request of the officers
-

The Obligation Concerning Relevant Evidence

In the case of a foreign national:

The relevant evidence referred to in subsection (1) includes photographic and fingerprint evidence and,

The foreign national would need to submit to a medical examination in accordance with the prescribed regulations

The Obligation Concerning Interviews

The authorities require foreign nationals who make applications to appear for interviews on the request of the officers
-
This is especially so for the purpose of an investigation that the Canadian Security Intelligence Service conducts under the provisions specified in section 15 of the Canadian Security Intelligence Service Act

When foreign nationals attend these interviews, the officers will be able to provide advice or information to the Minister as specified in the provisions of section 14 of that Act
-
Therefore, the authorities require that foreign nationals answer all questions truthfully put to them during the course of the interview

The Guidelines on Evidence Relating to Identity

An office might require or obtain evidence from a permanent resident or a foreign national that the authorities could use for establishing the identity of the foreign national or permanent resident

In addition, the officer could use this evidence to establish the compliance of the foreign national or permanent resident with the provisions of this Act
-
Such evidence could typically comprise photographic, fingerprint or any other kind of evidence
-
Officers will usually obtain these from permanent residents or foreign nationals who are:

Arrested
-
Detained
-
Subject to examinations or
-
Subject to removal orders
