              The Procedures for Reviewing Sponsorship and Permanent Residence Applications for Spouses, Common-Law Partners, Conjugal Partners and Dependent Children

              The Case Processing Centre in Mississauga (CPC-M) will need to review all the sponsorship and permanent residence applications forms and supporting documents. Thereafter, it will need to confirm that the documentation received includes the following documents, which must also be complete:

              • Completed and signed sponsorship forms (including the undertaking and the agreement)
              • The sponsorship application (which should only include spouses, common-law partners, conjugal partners and / or dependent children)
              • Completed and signed application for permanent residence forms
              • Proofs of payment of correct fees at a bank and,
              • All required supporting documents

              In some cases, officers might find that the application does not include the minimum requirements specified in R10 (1) and R10 (2). In such cases, the Case Processing Centre in Mississauga (CPC-M) will need to return the application and all documents to the sponsor. In addition, it will need to request for the missing information and documents. For more details on this, officers will need to go through the provisions specified in R12.

              In case the application is complete, the Case Processing Centre in Mississauga (CPC-M) will need to:

              • Assess the sponsor’s and co-signer’s eligibility – for more details on this, officers would need to go through the section titled ‘The Guidelines for Assessing a Sponsor’s Eligibility’ that appears subsequently in this document i.e. section 13 of IP 2
              • Complete the eligibility check – for more details refer to Appendix A
              • Write ‘Met or Not Met’ on the sponsorship application and,
              • Enter the basic data information into the Customs Processing Centre System (CPCS)

              In case the sponsor meets the prescribed sponsorship requirements, officers would need to go through the section titled ‘The Procedures in Case the Sponsor Meets the Sponsorship Requirements’ that appears subsequently in this document i.e. section 9.1 of IP 2.

              In case the sponsor does not meet the prescribed sponsorship requirements, officers would need to go through the section titled ‘The Procedures in Case the Sponsor Does Not Meet the Sponsorship Requirements’ that appears subsequently in this document i.e. section 9.2 of IP 2.

              The Procedures in Case the Sponsor Meets the Sponsorship Requirements

              In case the sponsor meets the prescribed sponsorship requirements, the Case Processing Centre in Mississauga (CPC-M) will need to:

              • Download the sponsorship information and recommendation to Computer Assisted Immigration Processing System (CAIPS)
              • Forward the application for permanent residence and supporting documents to the visa office responsible for the country of residence of the sponsored persons, without any additional information, such as:
                • Provide the relevant information (including the office of visa issuance and the file number), in case the sponsor received a visa abroad to come to Canada as a refugee or an adopted foreign national
                • Provide information on the date on which the sponsor met the conditions or from when the sponsor will need to meet the prescribed conditions, in case the authorities granted permanent residence to the sponsor subject to conditions
                • Provide details such as the details of removals, the office responsible for the enforcement action etc. in case there has been enforcement action involving the foreign national – this will help to ensure that the visa office recovers any removal costs (if applicable) and,
                • Provide any other relevant information that could affect the officer’s decision

              The Procedures in Case the Sponsor Does Not Meet the Sponsorship Requirements

              In case the sponsor does not meet the prescribed sponsorship requirements, the Case Processing Centre in Mississauga (CPC-M) will need to:

              • Reimburse the processing fee for the permanent residence application, should the sponsor opt to discontinue the application
                • Officers would need to go through the section titled ‘The Procedures for Handling a Discontinued or Withdrawn Undertaking’ that appears subsequently in this document i.e. section 12 of IP 2
              • Forward the permanent residence application to the visa office, in case the sponsor chooses to continue with the application
                • In addition, the Case Processing Centre in Mississauga (CPC-M) will need to indicate why the sponsor does not meet the prescribed sponsorship requirements or,
              • Suspend the processing of the sponsorship application until the officers render a decision in case the sponsor and / or the co-signer is the subject of any of the suspensions listed in the section titled ‘The Guidelines for the Suspension of Processing’ i.e. section 5.36 of IP 2
