              Quebec Employers Allowed to Change Work Permit Candidate on Positive LMIA

              Last Updated on July 27, 2020

              Quebec employers can now change the candidate on a positive Labour Market Impact Assessment (LMIA) without having to reapply.

              Effective July 24, 2020, employers hiring through the Temporary Foreign Worker Program (TFWP) can replace the candidate where the original candidate failed to obtain a Quebec Acceptance Certificate (CAQ) or work permit.

              Employers are also entitled to change the candidate for other reasons, provided no work permit has been issued by the federal government on the basis of the LMIA, according to the Ministry of Immigration, Francisation and Integration (MIFI).

              Employers cannot replace a candidate where a work permit has already been issued for a specific LMIA. 

              In a further change, MIFI says it will give candidates 60 days’ notice of its intent to refuse an application for temporary selection.

              The change is designed to give candidates the change to provide further information to prove they meet requirements. Only where candidates are unable to show they meet the requirements within the 60-day window will MIFI formally deny the application.

              “The purpose of these changes is to improve the efficiency of the review process for LMIA applications,” a MIFI statement said.

              Quebec Facilitated LMIA

              Earlier in 2020, Quebec updated the list of occupations that qualify for its facilitated Labour Market Impact Assessment process through the TFWP.

              The facilitated process means Quebec employers can recruit Temporary Foreign Workers for selected positions without needing proof of recruitment efforts.

              The list of occupations includes professions in high demand and industry sectors with labour shortages.

              It includes National Occupational Classification skill types 0, A and B.
