The Record of Employment (ROE) Web Agreement (herein after termed as the ‘Agreement’) governs the terms and conditions pursuant to which the Account Holder, through its users, will have access to the Record of Employment (ROE) Web Service for the objective of completing and submitting electronic Records of Employment (ROEs) to the Canada Employment Insurance Commission (herein after termed as the ‘Commission’).
The purpose of the Record of Employment (ROE) Web is to enable account holders and users with the means for:
- Creating electronic Records of Employment (ROEs)
- Printing electronic Records of Employment (ROEs)
- Viewing electronic Records of Employment (ROEs)
- Extracting electronic Records of Employment (ROEs) and,
- Amending electronic Records of Employment (ROEs)
All of these activities typically constitute managing electronic Records of Employment (ROEs).
This Agreement contains a number of provisions that could affect the rights and obligations of the account holders. As such, the account holders would need to read the entirety of this agreement carefully.
It is worth mentioning that the Primary Officer makes this Agreement available to the account holder. The Primary Officer has the authority to accept this Agreement on behalf of the account holder. The continued access to and the use of the Record of Employment (ROE) Web remains subject to:
- The acceptance of this Agreement and,
- The account holder’s compliance with the terms and conditions specified in this Agreement
The Definitions
The authorities have specified certain definitions that apply to the use of the Record of Employment (ROE) Web. These include the following:
- Account Holder – An account holder refers to an individual or an entity:
- That is obligated to complete and submit the Records of Employment (ROEs) to the Commission in accordance with the Employment Insurance Act and Regulations and / or,
- That is a service provider responsible for completing and submitting Records of Employment (ROEs) to the Commission on behalf of a client employer
- This is regardless of whether or not that particular client employer is registered with the Record of Employment (ROE) Web as an account holder
- Authorisation Code – This refers to a random, unique and temporary system generated code that the account holder will provide to the Primary Officer (PO) in order for the Primary Officer (PO) to complete the registration to the Record of Employment (ROE) Web.
- Client Employer – This denotes the individual or entity that has authorised a Service Provider to manage Records of Employment (ROEs) on its behalf in accordance with the Record of Employment (ROE) Web Client Employer Consent Form
- Main Business Address – This refers to the account holder’s business address as specified in the Account Holder Record of Employment (ROE) Web Account
- Primary Officer (PO) – This refers to an individual whom the account holder has designated to act on its behalf. The responsibilities of the Primary Officer (PO) include:
- Identifying and authenticating other individuals as representatives
- Administering the Account Holder’s Record of Employment (ROE) Web Account
- Accepting the Record of Employment (ROE) Web Agreement on behalf of the account holder
- This includes making the necessary amendments to the Record of Employment (ROE) Web Agreement as well and,
- Managing the Records of Employment (ROEs)
- Record of Employment (ROE) – For the purpose of the Record of Employment (ROE) Web, this refers to the electronic form of the Record of Employment (ROE). It is available for completion within the Record of Employment (ROE) Web. Employers would typically complete this form for people employed in insurable employment, who typically experience an interruption of earnings.
- Representative – This refers to an individual that the Primary Officer (PO) or another representative with appropriate access level typically identify and authenticate. The responsibilities of such representatives will vary based on the access level assigned to them within the Record of Employment (ROE) Web.
- Record of Employment (ROE) Web Account – This denotes the allotted space within the Record of Employment (ROE) Web, which the account holder can use for the purpose specified in the agreement. It is worth mentioning that the Record of Employment (ROE) Web account typically comprises one agreement and one Primary Officer (PO). It might also feature many representatives. In addition, it could have multiple Canada Revenue Agency (CRA) Business Numbers in relation to which the account holder manages the Records of Employment (ROEs).
- Record of Employment (ROE) Web Client Employer Consent Form – This refers to the form that the Commission typically supplies for confirming a service provider’s authority to manage the Records of Employment (ROEs) on behalf of a client employer
- Record of Employment (ROE) Web Enrollment – This denotes the process by which the authorities grant access levels to the Record of Employment (ROE) Web Account as a user to an individual
- Service Provider – This refers to an individual or an entity that:
- Provides accounting and payroll services to its client employers and,
- Has the relevant authorisations from its client employers for managing the Records of Employment (ROEs) on behalf of a client employer and in accordance with the provisions specified in the Record of Employment (ROE) Web Client Employer Consent Form
- User – This is a generic term that typically refers to the individuals having the authority to act on behalf of the account holder as either a Primary Officer (PO) or as a representative
- You – This refers to the Primary Officer (PO)
