Canadian Experience Class (CEC) Selection Criteria – The Temporary Resident Status
The applicant would need to have held a temporary resident status during the period of work, which qualifies the applicant for applying under the Canadian Experience Class (CEC). This is in accordance with the provisions specified in R87.1 (3) (c).
It is worth noting that the authorities are cognisant of the fact that certain foreign nationals could accumulate work experience while they have no temporary resident status in Canada. These individuals could typically include:
- Refugee claimants in Canada and,
- Unauthorised workers
Because of this, the authorities do not consider these individuals eligible for applying under the Canadian Experience Class (CEC).
Applicants applying under the Canadian Experience Class (CEC) do not need to hold a work permit. In addition, applicants who have the authorisation to work in Canada (under the provisions specified in R186) are eligible for applying under the Canadian Experience Class (CEC). However, these individuals would need to provide the relevant documentation along with their applications. The documentation submitted must establish clearly that the individuals had legal temporary status in Canada such as a visitor record etc.
Note:
- A Temporary Resident Permit (TRP) confers temporary resident status on an individual
- As such, applicants who obtained their qualifying work experience while in Canada on a Temporary Resident Permit (TRP) are eligible for applying under the Canadian Experience Class (CEC)
- As long as the work carried out by these individuals had the proper authorisation, these applicants are eligible for applying under the Canadian Experience Class (CEC)
- However, applicants who are inadmissible to Canada cannot obtain permanent residence as members of the Canadian Experience Class (CEC)
