There are two humanitarian-based groups of people that can be eligible for an open work permit. These people are also exempt from the LMIA requirement.
Students who, for reasons they cannot control, are unable to make enough money to pay their tuition through on-campus employment, will be eligible for an open work permit. In this case, the open work permit will only be valid until the period of study is over.
Temporary resident permit holders will be able to obtain an open work permit for humanitarian reasons if:
- They plan to live in Canada for more than six months
- They cannot support themselves without an open work permit
- Getting an open work permit will allow them to stay in Canada
The length of the open work permit will be the same as the length of the temporary resident permit.
